A new data protection challenge has begun for China-based companies operating in the European Union. Austrian privacy advocate Max Schrems led by NOYB (None of Your Business), TikTok, Ago, Xiaomi, Shein, AliExpress ve WeChat against popular platforms like GDPR He submitted his first complaints on the grounds of (General Data Protection Regulation) violations. The organization claims that these companies are illegally sharing European users’ information with parties in China.

NOYB said in a statement: “According to their privacy policies, AliExpress, SHEIN, TikTok and Xiaomi transfer data to China. Temu and WeChat talk about transfers to third countries. “Based on the corporate structure of Temu and WeChat, this likely includes China.” he said.

Within the scope of the complaint, NOYB demanded that the data transfers in question be stopped and that the companies were notified of global Fines of up to 4 percent of income requests to be given. This rate represents the maximum penalty limit stipulated in the GDPR and represents a serious financial sanction for companies. Noyb has filed six complaints in Greece, the Netherlands, Belgium, Italy and Austria to stop data transfers to China.

NOYB has previously made similar complaints against American technology giants such as Apple and Meta. Schrems’ cases against Facebook are considered turning points in the implementation of the GDPR. These complaints led to various investigations and billions of dollars in fines. Now the organization has turned its attention to China-based technology giants.
