In the petition submitted to the Supreme Court, it was stated that TikTok and ByteDance requested an injunction to stop the implementation of the “Protecting Americans from Foreign Enemy-Controlled Applications Act”.
In the petition, it was noted that the same request had previously been submitted to the Court of Appeal but was rejected.
On the other hand, Donald Trump, the elected president of the USA, also answered the question about the possibility of banning TikTok at the press conference.
Signaling that he was open to stopping the TikTok ban, Trump said, “We will take a look at TikTok. I have a warm feeling about TikTok.” he said.
Last year, the US administration took a step to either sell TikTok, which it accused of making American user information accessible to the Chinese administration, to a US company or ban it. In this context, the bill passed by Congress in March was signed by US President Joe Biden.
The Biden administration gave TikTok time until January 19, 2025 to end its relationship with Chinese ByteDance, otherwise the company would be banned in the USA and blocked from access by users.
TikTok, which has 170 million users, also applied to the Court of Appeals for the annulment of this law, arguing that it was against the freedom of expression in Article 1 of the US Constitution and the country’s “open internet” policy.
In TikTok’s application, it was also argued that the period granted by the US administration was very short and that it was not technically and practically possible to terminate its relationship with ByteDance during this period.
The Court of Appeals made its decision on TikTok’s lawsuit against the law on December 6. The court ruled in favor of the law that paved the way for TikTok to be banned.
